1. Agreement and eligibility
These terms govern access to Momentale's website, host accounts, business workspaces, event albums, guest links, invitations, Collections, uploads, Stories, slideshows, quizzes, and related services. By creating an account, accepting an invitation, joining as a guest, or using the service, you agree to these terms and the Privacy Policy.
You must be legally able to enter into this agreement. If you use Momentale for a business or organization, you confirm that you have authority to bind it. Children must not create accounts; adults remain responsible for child or family Collections.
2. The Momentale service
Momentale lets hosts create private shared albums and invitations, invite collaborators and guests, receive and moderate contributions, curate Stories, run venue displays and quizzes, and maintain authenticated long-term Collections. Features, storage, upload sizes, contribution windows, retention, and member capacity depend on the applicable plan and are shown in the product.
3. Accounts and access
- Provide accurate registration information and keep credentials confidential.
- Use individual accounts rather than sharing passwords.
- Hosts control guest links, permissions, passwords, expiry, moderation, and collaborators.
- Guest links and invitation links are private credentials. Recipients must not publish or redistribute them without the host's permission.
- Tell us promptly about suspected unauthorized access. We may revoke sessions or links to protect the service.
4. Host and business responsibilities
Hosts decide why an event or Collection is created, whom to invite, which service emails to send or schedule, which information to request, and which contributions are visible. Hosts must have a lawful and fair reason and any permission required to contact invitees, collect participant information, and provide event-specific notices where appropriate.
Do not request unnecessary sensitive data. RSVP dietary, accessibility, location, child, or custom-field information must be limited to what the event genuinely needs. Business workspace owners are responsible for members, venues, client permissions, branding, and transferring ownership before deleting an account.
5. Your content and permission to operate the service
You retain ownership of content you submit. You grant Momentale a worldwide, non-exclusive, royalty-free license limited to hosting, copying, transcoding, resizing, displaying, transmitting, backing up, moderating, and deleting that content as needed to provide and secure the service. This license ends when the content is deleted from active systems, subject to limited backup, legal, and dispute retention.
You confirm that you have the rights and permissions necessary to upload the content and make it available to the selected audience. Hosts may moderate or delete guest contributions. Guests can delete their own eligible contributions while the contribution window remains open and can contact the host or submit a privacy request afterward.
6. Acceptable use
Do not upload or use Momentale for illegal, abusive, threatening, exploitative, deceptive, infringing, malicious, or privacy-invasive activity. Do not upload malware; probe or bypass security; scrape private albums; overload the service; impersonate others; expose private links; or use content without permission.
Report tools must be used honestly. We may hide, restrict, preserve, or remove content and suspend access when reasonably necessary to enforce these terms, protect people, investigate abuse, comply with law, or keep the service reliable.
7. Plans, payment, renewal, and cancellation
Prices, currency, taxes, billing interval, included limits, and retention are displayed before checkout. Stripe processes payments. One-time event passes apply to the selected eligible event. Subscriptions renew for the displayed interval until cancelled.
You can manage or cancel a subscription through the Stripe Billing Portal linked from Plan & Usage. Cancellation normally takes effect at the end of the paid period. Failed renewal or cancellation may move eligible albums and Collections into read/download-only grace before access expires. Refund rights required by consumer law remain unaffected; otherwise completed purchases are refundable only where Momentale's checkout terms or support decision expressly allow it.
8. Retention, export, and deletion
Hosts can view applicable retention dates under Privacy & data. Download originals before their deadline. Expired or archived albums may stop accepting contributions or guest access before final deletion.
Account holders can export structured account data, download eligible album originals, permanently delete personal Collections, and delete an eligible personal account. Account deletion may require cancellation of a live subscription or transfer of business-owned data. Financial, security, audit, and legal records may be retained and anonymized as described in the Privacy Policy.
9. Availability and changes
We work to keep Momentale available, but events, uploads, media processing, maps, email, billing, and realtime features can depend on networks and third-party providers. Temporary interruption, maintenance, format incompatibility, or device limitations may occur. We may change or discontinue features, but will take reasonable steps to avoid materially reducing paid access during its paid period without notice or an appropriate remedy.
10. Momentale property and feedback
Momentale's software, brand, designs, documentation, and generated product interfaces remain owned by Momentale or its licensors. These terms give you a limited, revocable, non-transferable right to use the service. Feedback may be used without restriction or payment, without identifying you publicly.
11. Suspension and termination
You may stop using Momentale and use available deletion controls. We may suspend or terminate access for material breach, non-payment, security risk, abuse, or legal necessity. Where reasonable, we will provide notice and an opportunity to export eligible content. Immediate action may be required to protect guests, private content, or the service.
12. Warranties and liability
The service is provided with reasonable care and skill. Except for rights that cannot lawfully be excluded, Momentale does not guarantee uninterrupted service, permanent preservation, compatibility with every device or media format, or that user-submitted content is accurate or lawful.
To the extent permitted by law, Momentale is not liable for indirect or consequential loss, loss caused by user permissions or exposed links, unavailable third-party services, or content deleted after clearly disclosed deadlines. Nothing in these terms excludes liability that cannot legally be limited, including applicable consumer protections.
13. Governing law and disputes
These terms are governed by the laws of the Netherlands, without limiting mandatory consumer protections that apply where you live. Contact support first so we can try to resolve a dispute informally. Courts with jurisdiction under applicable law may hear unresolved disputes.
